    Earlier this year, Friends of the Earth brought a case against the UK Government to the High Court under Climate Change Act 2008…..long and short being that the court upheld the case for the claimant on the basis of a lack of required data in order to discharge a statutory duty. The judgement was not appealed by government.

    So what’s been the impact on public sector procurement ?

    Have un-successful suppliers now been claiming process propriety due to incomplete data collection against a statutory duty, be it Climate Change Act 2008, Equality Act 2010, or any other law on the books, either in the UK or in other jurisdictions ?

    Contracts as a result of faulty/illegal process necessarily ruled null and void ?

    RFxs and SRM programs recalibrated ?
